THE SENTENCING WAS HELD ON
APRIL 26,2001
The Texas Department Of Corrections handed
down a 10 year probated sentence. He was ordered to complete 180 days in the Dallas County Jail. 300 hours of community service,
to be done at the Mothers Against Drunk Driving Office in Irving. He also was ordered to complete several classes, such as
the DWI Education Program of Dallas, the Victim Impact Panel, and Youthful Drinking and Driving Progam. He had to have an
Ignition Interlock Device installed on his car, which is monitored and has to be checked once a month by the company who installed
it. He also must pay me restitution, that is tied to his 10 years of probation.
UPDATES ON THE DRUNK DRIVER:
APRIL 28, 2001
Two days after the sentencing. We are receiving prank phone calls. Lots
of them. They just set on the line and sometimes just slam the phone down when we answer. Got one that screamed a dirty
word. Not knowing if this has something to do with this case I decided I need to do something. So
I called the phone company and had caller ID installed. I Also called the police and had report done just in case. Have to
go to phone company and fill out forms to have tracker put on phone
JULY 20,2001
Received call at 9:00am from the Texas (V.I.N.E.)Victim Information Notification
Everyday program, that he had started the work release program. He has served almost 3 months and has 3 more months to
do.
OCTOBER 22,2001
Received a call at 6:30 am from the Texas
(V.I.N.E.) Victim Information Notification Everyday system. I was told that he had been let out of jail at 5:00 am that
morning. He had served 3 months of just jail time and 3 months of work release jail time.
JANUARY 25, 2002
Called Dallas Community Supervision and Corrections Department, because
I have not received a restitution check in several months. They told me that the offender had been given till January
30th to catch up all the payments that he had missed. I was told that if he did not get it paid by then, he would have to
go back infront of the Judge to explain why. I was also told I would be called if they received a payment of any kind.
FEBRUARY 1,2002
Dallas Community Supervision and Corrections Department called, The offender
had made a payment. He paid all but Februarys payment. He was given till February 28th to make the payment.
FEBRUARY 28, 2002
Dallas Community Supervision and Corrections Department called, he made
the February payment. Now he is all caught up till March 15th.
MAY 28,2002
Received a call from the Dallas Community Supervision and Corrections
Department. I was told that the drunk driver, has not been doing everything required by his probation. He is in violation
of his probation for several reasons. One being that he has not paid his restitution since February 28,2002. He is now several
months behind. They could not discuss the other violations with me. If he does not get everything caught up and be on the
right track by May 30,2002, we will have to go back to court to revoke his probation.
June 6, 2002
Called the Dallas Community Supervision and Corrections
Department. Was told that the offender did not make the deadline of May 30th to catch everthing up on his probation.
A letter was sent from his probation officer to the courts. A warrant should be out within the next
week and hopefully they will pick him up quick. A court date should be set within another month
or so, to revoke his probation or whatever the Judge decides to do this time.

I received a letter from
the DCCS & CD saying that a motion to revolk was issued on 6/14/02. It also says that he is still at large and as soon
as he is picked up he will have to go before the Judge of the Court regarding this motion and I will be notified when
this happens.

I called the
Dallas County CSCD about the letter I received. I was told that it was a letter to let me know that a bench warrant had been
issued for the drunk driving offender. He has several (9) violations with his probation. He not only has not paid me restitution
in several months, but he also has not reported in 3 months nor paid his probationn fees. He has
not showed up for his UA test appts. He did not finish his community service with Madd, nor did he do the CAT's program, to
see if he needs help with his addiction to alcohol. He owes money to the court for court fines and probation fees. But the
most scary thing to me is that his interlockin device has been tampered with and is no longer working and tracking his car. I
was also told they had been to several locations to find him and have had no luck so far, but will not give up. Nor will I!!!!!

Got a phone call from the Dallas County
Corrections and Probation Department, was told that the offender had been picked up
on the warrant on Friday July 19th. But he was released on Tuesady July 23rd. He paid his back restitution
and his back court fines and fees. He also has agreed to keep paying, reporting to his probation officer and finish all
his classes and programs, community service and have the Interlockin Device reworked on his car and have it monitored
as it should be.

Called to check on the offenders probation. So far
he is doing ok. He has showed up for his probation meetings, but only had his restitution for one month and not all of it.
He has started taking classes and counseling again. TIME WILL TELL!!!
November 5, 2002
Called to check on restitution payment and he made a payment, but not
even half of what he owns per month. He is due to catch it up by Nov 30th.
December 3, 2002
Called to see if he made up what he owes for last month and made a payment
for this month and was told he did not. He did not even show up for his meeting with his PO. So here we go again. They told
me to call them in two weeks to see what is being done by the PO!

Called back to check on the offender again. Was told that he has done
nothing to catch up so far. They said that they have sent two messages to his PO and got no response so they did not know
what was or was going to be done to fix this violation. They gave me the PO's name and number and told me to call him and
see if I can find out anything. Called him twice and was told he was not in yet the first time and then that he had already
left for the day the second time. I left a message both times I called, but have yet to hear back. I will keep trying. He
will not get away with this, he has gotten away with so much already. NOT THIS TOO!!!!

Called Dallas County again to check on the offender. I was told
nothing had been done yet. They are waiting till the 31st of Dec. If he does not contact them and try to catch up on his restitution
and probation fees by the 31st they will once again take court action.
I am to call them back on the 2nd of Jan...
January 2, 2003
Called back to Dallas County to see if he had paid anything or if
anything had happened yet to get him caught up. I was told that he had not reported or anything and that court action
had already been taken. Which means that the file has been sent to the Judge. I was told that a warrant should come out within
two weeks. I will be notified when a warrant does come out and when he is picked up. This time they are looking for prison
time. Atleast 2 years I was told.

Found out today that the warrant was prepared yesterday Jan. 13th and was signed
and issued by the Judge today Jan. 14th, 2003. I also found out that he sent in someone to make a payment towards his restitution.
But it was not enough to stop the warrant.
March 7th, 2003
Found out today that the offender was picked up on his violation of probation
warrant on Feb. 28th 2003. He is now in Dallas County jail waiting futher action.
Waiting for call back from court officer to find out what happens next!

The Dallas County Court Officer in charge of the case called me today.
He said that a court date has yet to be set. But when it is I will be notified so I can be there if I wish. He also told me
what the violations to his probation are. They are as follows: non-payment of restitution, non-payment of court
fines and fees, not reporting to his monthly probation meetings, not showing for UA's, not finishing his CAT's classes, not
finishing his community service with MADD, not having his Interlockin Device serviced and tampering with the device. He also
has a new offence on him now. He has been charged (but not convicted) of theft of over $500.00 dollars....
Seems he hasn't learned 1 single thing in these last few years!!

Received a restitution check for almost 2 months worth.
Will have to call Dallas County to find out who paid this and if he is
still in the County Jail. And to find out if there is anything new in his case. Like court dates or hearings.

Called Dallas County to find out about restitution check, but had to leave message.
I also called The Judges Court Coordinator and found out that a pre-trial hearing
has been set for this Friday April 4th. He still has a no-bond, so he should have to remain in jail till the final court date.
This hearing is just to see if he has a lawyer and what plans the lawyer has to try to fix this. If he does not have a lawyer
yet, he will have either 10 days to get one or they will apoint one for him.
I am to call Monday April 7th, to find out what happened. I will post it as
soon as I hear.

The Dallas County Corrections and Probation Department called me back. The restitution
check was mailed in, by "someone" in the family and I also found out that "they" sent in another one for a little over a months
worth due. It will be a few more weeks before I receive that one.
I suspect "they" are trying to catch up with this part of his probation so he
will look better infront of the Judge...

When the Dallas County Probation Department called me back, they ask me if I
already knew about the upcoming court day and if I had any questions about it. I told them what the court cordinator told
me and he said she was wrong. That this WAS going infront of the Judge and gave me all the details he had on it. Including
the Ass. D.A. that was on the cases phone number. I called that D.A. and was told that it WAS going infront of the Judge and
that I need to be there or send someone in my place. And with such short notice I was forced to ask my MADD advocate if she
would go only. It is set for Friday April the 4th at 9am...

My MADD advocate called me when it was over and told me that the Judge postponed
it. Till May the 2nd. The offender showed with his new lawyer and they said that there was testimony that they
wanted to give. And sense I was not there to give mine the Judge postponed it. They tried to talk her out of it, but she didn't
go for it.
So, now I have to go back to court with my family and testify. I will post what
happens as soon as it's over...

TODAY WAS THE REVOLKING OF PROBATION COURT DATE FOR THE DRUNK
DRIVING OFFENDER THAT DISABLED ME AT THE DALLAS COUNTY FRANK CROWLEY COURTS BUILDING.
HE PLEAD TRUE TO HIS PROBATION VIOLATIONS AND THE NEW OFFENSE. HE
WAS SENTENCED TO THE FULL 10 YEARS. TO START TODAY ON MAY 2ND 2003.
HIS FAMILY PAID A LARGE PART OF HIS RESTITUTION FOR HIM TODAY AND THE
REST WILL BE ADDED ON TO HIS PAROLE. WHENEVER HE IS PAROLED. HE WAS ALSO ORDERED TO TAKE AN ALCOHOL AND DRUG ABUSE COURSE
WHILE IN PRISON.

WHILE IN THE COURT ROOM DURING THE TESTIMONY WE LEARNED THAT THE NEW
OFFENCE (THE THEFT CHARGE) WAS FOR THE THEFT OF BEER AND LIQUOR. I WAS JUST SICK TO HEAR THIS. I KNOW NOW (FOR SURE) THAT
HE WAS DRINKING WHILE HE WAS ON PROBATION (2 YEARS) PROBABLY DRIVING WHILE DRUNK AS WELL. I FEEL FOR HIS FAMILY BUT I AM SOOO
HAPPY THAT CHARLIE IS OFF OF THE STREETS. ALL I COULD THINK OF WHEN I HEARD THIS WAS THAT HE WAS GOING TO DO WHAT HE DID TO
ME OR WORSE TO SOMEONE ELSE...

I RECEIVED A CALL FROM THE TEXAS V.I.N.E. (VICTIM INFORMATION NOTIFICATION EVERYDAY) AUTO
CALLING SYSTEM INFORMING ME THAT THE OFFENDER HAD BEEN PICKED UP AT 1:06 PM FROM THE DALLAS COUNTY JAIL. HE WAS
TAKEN TO THE TDCJ DIAGNOSTICS CENTER AT HUNTSVILLE. HE WILL STAY THERE FOR SEVERAL WEEKS GETTING PROCESSED. HE HAS TO GO THRU
ALL KINDS OF TESTING TO FIND OUT WHICH UNIT THEY WILL PUT HIM IN TO SERVE HIS TIME. THEY WILL PICK THE UNIT THAT THEY
THINK WILL HAVE THE PROGRAMS FOR HIS ALCOHOL AND DRUG NEEDS AS WELL AS EDUCATION NEEDS, LIKE GETTING HIS GED. I WILL BE NOTIFIED
WHEN HE IS MOVED TO HIS NEW UNIT.

I CALLED THE VICTIMS SERVICES DEPARTMENT FOR THE TDCJ (TEXAS DEPARTMENT
OF CRIMINAL JUSTICE) TO REGISTER MY NAME AND INFO TO GET UPDATES ON THE OFFENDER AND HIS PRISON TIME.

I ALSO CALLED MY DALLAS COUNTY ADVOCATE TO FIND OUT WHAT SHE KNEW ABOUT
HIM BEING MOVED AND THE PROCESS. SHE GAVE ME NEW PHONE NUMBERS AND HIS STATE ID NUMBER. SHE ALSO TOLD ME THAT THE OFFENERS MOTHER
HAD CALLED THE DAY BEFORE AND WANTED MY PHONE NUMBER OR ADDRESS. SHE SAID SHE NEEDED TO TALK TO ME. OF COURSE MY ADVOCATE
DIDN'T GIVE IT TO HER BUT TOOK HER NUMBER TO GIVE ME. SHE ALSO TALKED TO OUR JUDGE TO FIND OUT IF IT WAS OK TO TELL ME ABOUT
THE CALL AT ALL. SHE SAID IT WAS FINE BUT TO TELL ME TO DO WHATEVER I FELT WAS RIGHT. AFTER I HEARD THIS I CALLED MY MADD
ADVOCATE TO SEE WHAT SHE KNEW AND THOUGHT ABOUT THE CALL FROM HIS MOTHER. SHE SAID THAT SHE HAD TALKED TO MY COUNTY ADVOCATE
AND THAT THEY BOTH THOUGHT IT WAS BEST TO DO WHAT I FELT I NEEDED TO DO. THEY BOTH THINK THAT SHE WANTS TO TALK TO ME ABOUT
NOT WRITING LETTERS TO THE REVIEW BOARD. HIS FAMILY (FROM WHAT THEY COULD GET FROM HER CALL) ARE GOING TO ASK ME AND MY FAMILY
NOT TO WRITE LETTERS. THEY THINK HE WILL GET OUT IN OCTOBER OF THIS YEAR IF THE REVIEW BOARD DOESN'T GET LETTERS FROM US.

THE OFFENDER WAS MOVED FROM THE HUNTSVILLE TEXAS DIAGNOSTIC CENTER TO A
MORE EXTENSIVE TESTING UNIT IN ABILENE TEXAS. HE SHOULD BE IN THIS UNIT FOR A FEW WEEKS BEFORE BEING MOVED TO A REAL UNIT
IN THE TEXAST PRISON SYSTEM.

RECEIVED A LETTER FROM THE DIRECTOR OF VICTIMS SERVICES FOR THE TEXAS DEPARTMENT
OF CRIMINAL JUSTICE. THE LETTER WAS TO NOTIFY ME THAT THE REVIEW BOARD IN AUSTIN TEXAS HAS RECEIVED MY IMPACT LETTERS TO STOP
HIS RELEASE. I SENT IN 13 LETTERS FROM FAMILY AND FRIENDS AND ALREADY HAVE 3 MORE SO FAR TO SEND IN.

RECEIVED NOTIFICATION THAT HE HAS BEEN MOVED AGAIN. THIS TIME TO A REAL
PRISON UNIT, OUT OF THE TESTING UNITS. HE IS NOW IN AN EL PASO TEXAS UNIT. HE IS NOW IN NORMAL POPULATION.

GOT A CALL FROM THE TEXAS DEPARTMENT OF CRIMINAL JUSTICE. THEY WANTED TO INFORM
ME THAT THE OFFENDER HAD BEEN MOVED AGAIN. THEY ALSO WANTED TO ASK IF I WANTED TO DO A PHONE INTERVIEW WITH THE
REVIEW BOARD WHEN THE TIME COMES. I OF COURSE SAID YES AND WILL AWAIT THEIR CALL.

Received a call from the Texas Parole and Review Board today. I was told to call
between December 29th and January 2nd to request an interview with the "first chair" voter on the review board for the offender
in my case. After I call, the first chair will call me back within a week for a phone interview.

Called the Texas Pardons and Parole Board to request an interview. I was
told that the first chair Ms. S____ would call me back after the first of the year (2004).
Called my MADD advocate to let her know that it was time for the interview because
she wanted to do one too. She called that morning and requested an interview too.
JANUARY 5, 2004
Received the phone call from Ms. S____, the first chair on the parole
review board. We went thru my injuries and the details of the crash. I told her about how my life has changed now due
to this guys actions. I told her about the new offense he commited while on probation and how he has shown no remorse.
I also told her about how he didn't do any of his probation requirments and how he had three chances with the Judge and messed
up all three.
It was a very tough hour. I had been going over in my head for weeks
about what I was going to say and even wrote notes. But it wasn't as easy as I thought. Reliving it was unreal! But she said
it looked as though he was not going to get out, but that there was still the second chairs vote to go and if they didn't
vote the same, the third chair was the tie breaker.
I should hear something within a week or two.
When we hung up she was going to call Susan to do their interview. Can't
wait to hear something! I hate waiting...

My MADD advocate emailed me and said that she had her interview
with the first chair Ms. S_____. She also said she thought that he wasn't going to get parole.... God I hope she
is right. It just hasn't been enough time in my opinion...not even for the alcohol classes.
Have to wait till I get the official letter from the Review Board!
Should be a week or so...
